Corporate Tax Late Registration Penalty Waiver Initiative

A Cabinet-approved initiative that can waive or refund your AED 10,000 Corporate Tax penalty.

If your business missed its Corporate Tax registration deadline, the FTA's standard response is an automatic AED 10,000 administrative penalty. Since 7 May 2025, however, the Federal Tax Authority has operated a dedicated penalty waiver initiative — set out in Public Clarification CTP006 — that exempts or refunds this exact penalty for businesses that take corrective action quickly. This is one of the most important compliance opportunities available to UAE businesses right now, and it is time-bound: it depends entirely on how soon you file your first tax return after missing your original deadline. We assess your eligibility, prepare the required filings, and manage the process directly with the FTA on your behalf.

The Three Scenarios the Waiver Covers

  • Registered late, penalty not yet paid: file your first tax return within 7 months of your first tax period's end, and the AED 10,000 penalty is waived outright — you're never charged
  • Registered late, penalty already paid: file within the same 7-month window and the FTA refunds the amount you already paid, with no separate refund application required
  • Not registered at all yet: submit your registration application and your first tax return together, both within 7 months of your first tax period's end, to qualify for the same exemption

Why This Matters So Much Right Now

Many UAE businesses — especially smaller companies and free zone entities that assumed a 0% rate meant no obligations — missed their original Corporate Tax registration deadline without realizing it. Historically, that meant an unavoidable AED 10,000 penalty. This waiver initiative changes that, but only for businesses that act within the 7-month filing window. Outside that window, the standard penalty applies in full and continues to sit on your FTA record. Time is the single biggest factor in whether you qualify — the sooner you engage, the more likely you are to fall within the window.

Checking Your Eligibility

The FTA provides an official Corporate Tax Late Registration Penalty Waiver Check tool, which requires signing in with UAE Pass and entering your entity's establishment date and first tax period. We recommend confirming your exact original registration deadline first, since the waiver window is calculated from your first tax period's end, not from today's date.

How We Help

  • Confirm your original registration deadline and first tax period
  • Assess which of the three waiver scenarios applies to your business
  • Register (if not yet done) and prepare your first Corporate Tax return within the qualifying window
  • Liaise directly with the FTA as your registered tax agent to confirm the waiver or process the refund

Relevant Laws & Regulations

  • FTA Public Clarification CTP006 (implemented 7 May 2025)
The Cabinet-approved waiver initiative itself — waives or refunds the AED 10,000 late-registration penalty for taxable persons who file their first tax return or annual declaration within 7 months of their first tax period's end.
  • Cabinet Decision No. 75 of 2023, as amended by Cabinet Decision No. 10 of 2024
The underlying law that sets the flat AED 10,000 administrative penalty this waiver initiative provides relief from.
  • FTA Decision No. 3 of 2024
Defines the original registration deadlines that, if missed, is what puts a business into late-registration penalty territory in the first place.
